Acceptance and Modification of Terms of Use

By using the Association de la construction du Québec (ACQ) website www.modulec.ca(the "Site"), you agree to the terms and conditions below.

These terms may be modified at any time. It is therefore advisable to review them on a regular basis.

Description of the Service

The Site offers information for users who are interested in learning about the construction industry in Quebec, in particular in the areas of training, market development, new practices, health and safety, technological innovations, and sustainable building, as well as lobbying activities with government authorities and other social and economic stakeholders in Quebec and Canada.

Intellectual Property Protection Policy

The information contained in the Site is the intellectual property of ACQ. Unless otherwise noted, ACQ's rights apply to all of the documents, data, compilations, and other works distributed on the Site. Trademarks are also protected.

Limited License

ACQ grants site users a limited license allowing them to display on their computer, print, download, and use underlying HTML code, text, audio clips, video clips, and other accessible content on the Site at no cost and without permission, provided they mention the source and use them solely for non-commercial, personal, or educational purposes, on the condition that

  1. They do not modify the content; and
  2. They include with and display on each copy of the content a mention of the corresponding copyright and this limited license.

No other use is allowed.

For commercial use, prior permission must be obtained from ACQ. See the section "Intellectual Property Rights."

Integrity of Information

ACQ guarantees integrity of information at the precise moment when the information appears on the Site and not thereafter. It in no way guarantees any document, data, or other content once it is altered or modified in any manner, whether after download or not. Furthermore, in the event of a discrepancy between an official text and content on the Site, the official text takes precedence.

Intellectual Property Rights

Intellectual property rights are exclusive rights held by ACQ over the documents it produces and publishes, whether these documents are administrative or official texts and whether they are created by its employees, a government ministry, a public body, or a third party that has assigned its rights to ACQ or granted ACQ a license to use them. These rights include copyrights, trademarks, and patents.

For example, the compilations of data and information contained on this Site are works protected by copyright just as any multimedia, literary, musical, or artistic work.

In order for third parties to use items covered by such rights they must, unless otherwise indicated and with exceptions stated in the relevant laws, obtain authorizations, licenses, permissions, or concessions of interest from the rightsholders. This applies in particular to reproduction, storage, and saving for purposes other than those strictly permitted.

Therefore, anyone who plans or wishes to reproduce, store, download, translate, publicly present audio or images, or communicate by telecommunications any document, data, or other content of the Site for commercial purposes must obtain the prior permission of ACQ. This permission can be obtained by contacting ACQ's Legal and Government Affairs department.

Furthermore, when using these works, in the broad sense, no one may remove the name of the rightsholder or modify the content, whether by addition, deletion, or otherwise, without infringing ACQ's moral rights.

Intellectual Property Notice

ACQ holds the intellectual property rights related to the visual and graphic identity of the Site, the text, the audio clips, the Web video clips, and other Site content accessible to users, or has obtained the permission of the content's rightsholders before using it on the Site.

Trademarks

"ModuleC" and "Consult, Collaborate, Construct" are trademarks of ACQ. The names of other products and services mentioned on the Site are trademarks of their respective owners. The display of trademarks or trade names on this Site neither transfers nor creates licenses or other rights regarding these trademarks or trade names. Any unauthorized use of these is strictly prohibited.

Links to Other Websites

The Site includes links to other websites. As ACQ cannot control these sites, it cannot guarantee the accuracy and completeness of the content, advertisements, products, services, or any other materials available on or from these sites. Furthermore, ACQ cannot be held liable for any loss or damage, proven or alleged, consequential or related to the use of or faith put in the content, goods, or services available on these external sites.

About the Site

Some of the information found on the Site comes from government administrations, ministries, agencies, and other external sources. ACQ had made every possible effort to ensure the accuracy, currency, and reliability of the Site's content. Sections of the Site are reviewed regularly. However, sometimes certain recent modifications may not be found on the Site. If this happens, please advise ACQ.

Limitation and Exclusion of Liability

The Site may contain inaccuracies or typographical errors. Under no circumstances will ACQ be liable for damages of any type whatsoever, including real, indirect, and consequential damages, resulting from the use or the relevance of the information available on the Site or related to the Site.

ACQ takes care to keep this site up to date to reflect current prices and services. Nevertheless, prices may change without notice. Please note that product prices are in Canadian dollars and do not include taxes. However, taxes are included in the order total displayed in your shopping cart.

Online Payment Terms

Only Visa and MasterCard are accepted for online purchases.

Refund Policy

All orders of plans and specifications and all package purchases are non-refundable and cannot be exchanged.
